General terms and shipping
The owner of the online www.paulberg.eu (hereinafter referred to as the online store) is PaulBerg Outdoor OÜ (registry code: 16188595), Tööstuse tn 43-72 Tallinn Harjumaa 10411, Estonia (email@example.com).

1. THE VALIDITY OF CONTRACT OF SALE, PRODUCT AND PRICE INFORMATION
The conditions of sale apply to purchases of goods from the online store. In addition to the conditions set out on this page, the relationship between the consumer and the online store is regulated by the Estonian Law of Obligations Act, Consumer Protection Act and other important legislation in force in the Republic of Estonia.1.2.
The prices of the product sold in the online store is indicated next to the product. A fee for shipping is added to the price. All prices are in Euros (€). Product information is provided immediately adjacent to the product in the online store.1.3.
The shipping cost depends on the location of the purchaser and the shipping method. The shipping cost is displayed when the purchaser places the order. The purchaser bears the shipping cost according to the selected shipping method.
2. PLACING AN ORDER
Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid securely via the following payment methods:
- bank link
- credit card payment
When paying through a bank link, you must choose the bank that suits you to make the payment, the payment link is mediated by Montonio Finance UAB. Payment takes place outside the online store in a secure environment – when paying with a bank link in the secure environment of the respective bank.2.3.
For credit card the seller does not have access to the customer’s bank and credit card details.2.4.
The contract enters into force when the amount payable is transferred to the bank account of the online store.2.5.
If the online store cannot deliver the ordered goods due to stock running out or for any other reason, the purchaser will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification.
Goods are shipped to all EU countries. In case a purchaser is located in third country, please contact firstname.lastname@example.org with the inquiry whether the goods can also be specially shipped to the purchaser country.3.2.
The purchased products will be sent out by the store’s partner Pakipoint no later than the next working day. Exceptionally, if there is a waiting list in parcel machines, it may take up to 5 days to complete the order.3.3.
All shipping costs must be paid by the buyer and the costs are provided at the check-out.3.4.
All shipments within Estonia arrive generally at the destination specified by the purchaser within 7 business days of the date of entry into force of the contract of sale. All shipments within EU country arrive in general within 14 calendar days.3.5.
The online store has the right to ship goods in up to 45 calendar days in exceptional cases.
4. RIGHT OF WITHDRAWAL AND RETURNS
After receiving the order, the purchaser has the right to withdraw from the contract entered into with the online store within 14 days. The right of withdrawal does not apply if the purchaser is a legal person.4.2.
Pursuant to Law of Obligations Act (§ 53 (4)), the right of withdrawal does not apply to a contract the object of which is:
- delivery of goods manufactured taking into account the personal needs of the consumer who is a party to the contract;
- for delivery of goods manufactured according to the conditions established by the consumer;
To exercise the 14-day right of withdrawal, the purchaser must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics, and functioning of the goods in the same way the purchaser would be allowed to test the goods in an actual store.4.4.
If the goods have been used in any other way than it is necessary to ensure the nature, characteristics, and functioning of the goods in the same way the purchaser would be allowed to test the goods in an actual store, the Online Store has the right to decline a refund request or reduce the refundable fee according to the decrease in the value of the goods.4.5.
In order to return the goods, the request to return the goods to the online store must be notified in writing to email@example.com. The costs of returning the goods shall be borne by the the buyer.4.6.
The purchaser must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they have handed over the goods to the carrier within the aforementioned period. Purchased footwear is eligible for a return, if they are with tags, and in its original packaging.4.7.
Upon receiving the returned goods and validating that the goods have been kept as foreseen in point 4.3 of these general terms, the online store shall return to the purchaser, immediately but no later than after 14 days, all of the payments received from the purchaser based on the contract, except the costs paid for the goods to be shipped to the purchaser.4.8.
The online store has the right to refuse to make a refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.
5. DEFECTIVE GOODS
The purchaser has the right to turn to the online store within two months of the occurrence of a defect by e-mailing firstname.lastname@example.org.
The online store is not liable for any defects arising after delivering the goods to the purchaser.5.3.
If goods bought from the online store have defects for which the online store is responsible, the online store will replace the defective goods. If the goods cannot be replaced, the online store shall return to the purchaser all of the payments involved in the contract of sale.5.4.
The online store will respond to the purchaser complaint about a defective good in written form or in a form that enables written reproduction within 5 days.
6. DIRECT MARKETING AND PROCESSING OF PERSONAL DATA
The online store only uses the personal data entered by the purchaser for processing the order and sending goods to the purchaser. The online store forwards personal data to the transport service provider in order to deliver the goods.
7. SETTLEMENT OF DISPUTES
All complaints made by a purchaser about the online store must be e-mailed to: email@example.com.
If the purchaser and the online store are not able to settle the dispute by agreement, the purchaser may contact the Estonian Consumer Dispute Committee. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the online store. A purchaser may also turn to the dispute resolution bodies of the European Union.
